Deliveries & Returns
1 Any delivery date quoted by Helium Club shall be deemed to be an estimate only and Helium Club shall not be under any liability to the Purchaser for late delivery provided that if delivery is not made by the Helium Club within 14 days of the quoted delivery date. In any event, delivery times are approximate and variable. When delivery is affected to the Purchaser directly or to an independent delivery contractor as agent for the purchaser, risk shall pass to the buyer immediately.
1.1 Helium Club shall be entitled to make delivery by instalments in accordance with any agreed schedule with the Purchaser. Once the schedule has been agreed, the Purchaser shall not be entitled to cancel or vary the schedule for any reason whatsoever unless agreed in writing by Helium Club. If the Purchaser wishes to delay or alter any provisions of the schedule, any delay, or alteration must be agreed in writing by the Helium Club.
1.2 Unless otherwise agreed in writing by Helium Club delivery shall be to the Purchaser at an address of the Purchaser as shown on the purchase order.
1.3 If the Purchaser shall fail to take delivery within seven days of notice by Helium Club that the Goods are ready for delivery, the Purchaser shall be liable for extra expense incurred by Helium Club as a result thereof including a reasonable charge for the cost of insuring and storing the Goods pending delivery.
1.4 a) All claims for damage to or partial loss of Goods in transit must be made by notice in writing to Helium Club within seven days of delivery to the Purchaser or the agent of the Purchaser and any delivery note must be endorsed accordingly on delivery; and b) All claims of non-delivery of the whole consignment or package must be made by notice in writing to the carrier and the Helium Club within seven days of receipt by the Purchaser or the agent of the Purchaser of Helium Club’ invoice or advice note (whichever is received first): c) In the absence of notification of claims in accordance with the provisions of this Condition the Purchaser shall be deemed to have received the Goods in accordance with the terms of the Contract.
1.5 The rights of the Purchaser under Condition 1 shall constitute the sole and exclusive remedy of the Purchaser for late or non- delivery of the Goods.
1.6 Missing items, occasionally, on orders comprising of multiple parcels, the courier may not deliver the full order all at once. If the balance of the order does not arrive the next day the Purchaser must contact Helium Club who will investigate the delay and report any findings to the Purchaser.
1.7 If the Purchaser has a problem with a custom-made product, including a longer delivery time than expected, contact Helium Club who will do everything they can to help. However, please remember custom orders cannot be cancelled or returned unless they are faulty.
1.8 The Purchaser cannot return goods if they no longer want the items, unless the item delivered does not match the Purchaser's order, or the item is damaged on arrival. However, if the Purchaser is unsure which product would best suit their needs, it is recommended that they contact Helium Club directly before placing an online order to obtain specialised product advice.
